1. Acceptance of Terms

By accessing or using the XPest website at https://thexpest.com/, or by scheduling, purchasing, or receiving any pest control services from XPest Pest Control, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please discontinue use of the Site and do not engage our services.

2. Services

XPest provides residential and commercial pest control services in the Treasure Valley region of Idaho, including but not limited to Boise, Nampa, Meridian, Eagle, Caldwell, Kuna, Star, Garden City, and Middleton. Services include rodent control, bed bug elimination, ant and colony control, mosquito treatment, cockroach extermination, spider control, wasp and hornet removal, fly control, and wildlife exclusion.

XPest operates under Idaho pest control license number ID-PCT-2024 and employs EPA-certified applicators. All treatments are applied in accordance with applicable federal, state, and local regulations.

3. Free Inspection & Estimates

XPest offers free property inspections and estimates with no obligation to purchase services. Scheduling a free inspection does not constitute a service agreement. A separate service agreement or work order will be provided prior to the commencement of any paid treatment.

4. Service Guarantee

XPest provides a 30-day satisfaction guarantee on all completed treatments. If a treated pest problem returns within 30 days of your service date, XPest will return to re-treat the affected area at no additional charge. This guarantee is subject to the following conditions:

  • The re-service request must be made within 30 days of the original treatment date.
  • The guarantee applies only to the pest type(s) included in the original treatment.
  • The guarantee does not apply to new or unrelated infestations, or to conditions caused by the customer's failure to follow post-treatment instructions.
  • Commercial service guarantees are governed by the terms of the applicable service agreement.

5. Customer Responsibilities

To ensure effective treatment and protect the health and safety of XPest technicians, customers agree to:

  • Provide accurate information about the pest problem and property conditions prior to and during service.
  • Follow all pre-treatment and post-treatment instructions provided by XPest technicians.
  • Ensure safe access to all areas of the property requiring inspection or treatment.
  • Disclose any known hazards, allergies, or sensitivities (including those of pets and household members) before treatment begins.
  • Notify XPest promptly if any adverse reactions to treatments occur.

6. Payment Terms

Payment terms, pricing, and service fees will be outlined in your individual service agreement or invoice. XPest reserves the right to update its pricing at any time. Any changes to pricing for ongoing or recurring service plans will be communicated with reasonable advance notice.

7. Use of the Website

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable law or regulation.
  • Transmit unsolicited advertising, spam, or promotional material.
  • Attempt to gain unauthorized access to any part of the Site or its systems.
  • Introduce malware, viruses, or other harmful code.
  • Scrape, harvest, or collect information from the Site without our prior written consent.

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, service descriptions, and software — is the property of XPest Pest Control or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written permission.

9. Disclaimer of Warranties

The Site and all content are provided on an "as is" and "as available" basis. XPest makes no warranties, express or implied, regarding the Site's accuracy, reliability, availability, or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.

With respect to pest control services, XPest makes no guarantee of complete or permanent pest eradication, as pest activity can be influenced by environmental factors, customer behavior, and conditions beyond our control. Our 30-day guarantee is the sole and exclusive remedy for dissatisfaction with treatment results.

10. Limitation of Liability

To the fullest extent permitted by applicable law, XPest and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, including but not limited to property damage, loss of income, or any other damages resulting from pest activity or treatment.

XPest's total liability to you for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless XPest, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your provision of inaccurate or incomplete information that affects service delivery.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles. Any disputes arising under these Terms or related to XPest's services shall be resolved in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of such courts.

13. Modifications to Terms

XPest reserves the right to modify these Terms at any time. Updated Terms will be posted on the Site with a revised effective date. Your continued use of the Site or our services following the posting of changes constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
